Terms of Service

1. Acceptance of Terms

By installing, accessing, or using Rephraser: LLM Writing Assistant ("the Application", "we", "our", or "the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Application.

2. Service Architecture

The Application operates as follows:

1. Your text is transmitted securely to our servers
2. We process and forward it to your selected third-party LLM provider (e.g., Google Gemini, etc.)
3. Results are returned through our servers to your device
4. Your text is permanently deleted from our servers after processing

Important: We act solely as an intermediary service. The actual AI processing is performed by third-party LLM providers.

3. User Responsibilities

3.1 Acceptable Use

You may use the Application for lawful writing assistance purposes, including but not limited to:

• Rephrasing and improving text clarity
• Grammar and spelling correction
• Enhancing writing style and fluency
• Professional and personal communication assistance

3.2 Prohibited Uses

You agree NOT to:

• Submit illegal, harmful, threatening, or infringing content
• Use the service for spam, harassment, fraud, or malicious purposes
• Attempt to reverse engineer, decompile, or compromise our systems
• Submit highly sensitive data (Social Security Numbers, financial account details, medical records, etc.) without understanding and accepting the risks
• Violate any third-party LLM provider's terms of service
• Use the service to generate content that violates intellectual property rights
• Abuse, overload, or disrupt the service infrastructure
• Circumvent usage limits or authentication mechanisms

4. Limited Processing Responsibility

4.1 Our Limited Role

We act as a processing intermediary and facilitator:

• We temporarily handle your text on our servers to facilitate transmission to LLM providers
• We do NOT claim ownership of your text
• We do NOT use your text for training our own models
• We do NOT retain your text after processing is complete
• We do NOT share your text with any parties other than your selected LLM provider

4.2 Third-Party Liability Waiver

WE EXPLICITLY DISCLAIM ALL RESPONSIBILITY AND LIABILITY FOR:

• Data handling, security, or privacy practices of third-party LLM providers
• Accuracy, reliability, quality, or appropriateness of LLM-generated content
• Data breaches, leaks, or unauthorized access occurring at third-party services
• Any violation of laws or regulations by LLM providers
• Service interruptions, downtime, or failures of third-party APIs
• Changes to third-party LLM provider policies or pricing
• Content moderation decisions made by third-party providers

You acknowledge that: When you use this Application, you are subject to the terms, policies, and data practices of the third-party LLM provider you select. We strongly recommend reviewing their terms of service and privacy policies.

5. Google Authentication

If you choose to authenticate using Google OAuth:

• We request minimal permissions necessary for authentication (userinfo.email and userinfo.profile)
• Your Google data usage is governed by Google's Terms of Service and Privacy Policy
• We use this information solely for authentication, account management, and usage quota tracking
• You can revoke access at any time through your Google account security settings

6. Intellectual Property

6.1 Your Content

• You retain all rights, title, and interest in your original text and content
• By using the Service, you grant us a limited, temporary license to process your text solely for the purpose of providing the service

6.2 Generated Content

• Content generated by LLM providers may be subject to the LLM provider's terms of service
• We make no claims or warranties regarding the intellectual property status of AI-generated content
• You are responsible for ensuring your use of generated content complies with applicable laws

6.3 Our Property

• The Application's software, design, algorithms, and technology remain our exclusive property
• You may not copy, modify, distribute, or create derivative works without our written permission

7. Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We explicitly disclaim all warranties, express or implied, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Uninterrupted, timely, secure, or error-free operation
• Security or privacy of data transmitted to or processed by third-party services
• Accuracy, completeness, or reliability of LLM-generated suggestions or content
• Compatibility with all devices, operating systems, or configurations
• Freedom from viruses, malware, or other harmful components

You use the Service at your own risk.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR:

• Any damages arising from your use of third-party LLM services
• Loss, exposure, theft, or unauthorized access to your text data
• Decisions made or actions taken based on LLM-generated content
• Indirect, incidental, consequential, special, punitive, or exemplary damages
• Loss of profits, revenue, data, goodwill, or business opportunities
• Data breaches, security incidents, or privacy violations at third-party services
• Service interruptions, errors, or unavailability

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, OR $100 USD, WHICHEVER IS LESS.

Some jurisdictions do not allow certain liability exclusions, so some of the above limitations may not apply to you.

9. Indemnification

You agree to indemnify, defend, and hold harmless Rephraser: LLM Writing Assistant, its developers, affiliates, and partners from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Application
• Your violation of these Terms of Service
• Your violation of any third-party LLM provider's terms or policies
• Your submission of unlawful, infringing, or harmful content
• Your violation of any applicable laws or regulations
• Claims by third parties related to your use of the Service

10. Service Availability and Termination

10.1 Service Availability

• We strive to provide reliable service but do not guarantee uninterrupted availability
• We reserve the right to modify, suspend, or discontinue the Service at any time without prior notice
• Scheduled maintenance may temporarily interrupt service

10.2 Termination by Us

We may suspend or terminate your access for:

• Violation of these Terms of Service
• Fraudulent, abusive, or illegal activity
• Excessive use that impacts service quality for others
• Non-payment of fees (if applicable)
• Any reason, at our sole discretion

10.3 Termination by You

You may stop using the Application at any time by uninstalling it and revoking authentication permissions.

11. Modifications to Terms

• We reserve the right to modify these Terms of Service at any time
• Changes will be effective immediately upon posting the updated terms
• Your continued use of the Application after changes constitutes acceptance of the new terms

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law principles.

• You agree to waive your right to participate in class action lawsuits
• Nothing in this section prevents either party from seeking injunctive relief in court

14. Miscellaneous

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

14.3 Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.

14.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.

14.5 Force Majeure

We shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, or third-party service failures.
